Privacy policy

How we collect, use, store and protect personal and financial information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Who we are

FamilyLawSuper.com.au is the family law specialist offering of TCW Actuarial. References in this policy to "we", "us" and "our" mean TCW Actuarial trading as FamilyLawSuper.com.au. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. What we collect

  • Identity information (full name, date of birth, contact details).
  • Family law matter information (cohabitation date, separation date, names of parties, instructing solicitors).
  • Superannuation information (member statements, fund correspondence, ATO MyGov contribution histories, defined-benefit scheme records).
  • Communications (emails, file uploads, intake submissions).

3. Why we collect it

We collect personal information for the purpose of preparing actuarial valuations and expert reports, conducting conflict checks, communicating with parties and their legal representatives, and complying with our professional and statutory obligations (including under the Family Law Act 1975 (Cth) and the Actuaries Institute's Code of Professional Conduct).

4. How we store and protect it

All documents are received via encrypted upload and stored on Australian-hosted infrastructure. Access is restricted to the assigned actuary and a named support analyst. We do not use client data to train any artificial-intelligence system. We retain matter records for seven years (consistent with Australian Taxation Office requirements and Actuaries Institute professional standards), after which they are securely destroyed.

5. Disclosure

We disclose personal information only: (a) to the parties and their legal representatives in the matter; (b) to a court or tribunal where required by law or court order; (c) to the originating superannuation trustee where you have authorised us in writing to make enquiries on your behalf; (d) to professional advisers bound by equivalent confidentiality obligations. We do not sell or rent personal information.

Enquiries sent to info@familylawsuper.com and submissions made via the contact form on this site are received by the assigned actuary and a named support analyst only. Email content (including any attachments) is treated as confidential matter correspondence from the moment it is received, stored on Australian-hosted infrastructure, and retained alongside the matter file in line with section 4 above. We do not add enquirers to marketing lists, and we do not share enquiry content with any third party except as set out in section 5. If you decide not to engage us, you may request that your enquiry and any attachments be deleted, and we will do so within 30 days unless we are required to retain the records for professional or legal reasons.

6. Your rights

You may request access to, or correction of, the personal information we hold about you. You may also withdraw instructions at any time, in which case we will return or destroy your records on request, subject to the seven-year retention requirement above where the information forms part of a delivered report.

7. Complaints

Privacy complaints should be addressed in writing to Yiannis (John) Tellyros (john@tcwactuarial.com.au). If a complaint is not resolved to your satisfaction you may escalate it to the Office of the Australian Information Commissioner (oaic.gov.au).

8. Updates

We review this policy at least annually and update the "Last reviewed" stamp at the top of this page when changes are made.
